Mission
NACA is a non-profit association of attorneys and consumer advocates committed to representing customers' interests. Our members are private and public sector attorneys, legal services attorneys, law professors and law students whose primary focus is the protection and representation of consumers. NACA also has a charitable and educational fund incorporated under ยง501 (c) (3).
NACA's mission shall be to promote justice for all consumers by maintaining a forum for communication, networking, and information sharing among consumer advocates across the country, particularly regarding legal issues, and by serving as a voice for its members and consumers in the ongoing struggle to curb unfair or abusive business practices that affect consumers.
NACA's Key Issues
- Challenging binding mandatory arbitration clauses and other impediments to consumers' access to justice;
NACA strongly opposes the use of BMA clauses in almost all consumer contracts. NACA instead believes that Congress must amend the Federal Arbitration Act to protect consumers and other individuals (like employees and contract farmers) who are otherwise being forced to give up their access to our nation's justice system through these non-negotiable and cynical clauses. - Credit Card Reform
NACA supports the re-regulation of the credit card industry that has made billions of dollars by engaging in unfair and deceptive practices that have left millions of Americans mired in perpetual debt. - Bank Fees, Federal Bank Law Preemption and Predatory Financial Practices
NACA supports federal action to repeal the actions by the Office of the Comptroller of the Currency (OCC) overriding all state consumer protection and predatory lending laws applying to national banks and their operating subsidiaries. NACA opposes Congressional efforts to preempt, or over-ride, stronger state rent-to-own, payday loan and predatory mortgage lending laws. - Consumer Financial Privacy and Accuracy
NACA supports federal regulation and laws that will require financial companies, including consumer reporting agencies, government agencies, and Internet sites to better protect our Social Security Numbers and other confidential financial information. NACA opposes any attempt to preempt the right of states to enact stronger financial privacy and accuracy laws. - Legal Reform
NACA oppose bills intended to reduce the rights of consumers injured by unsafe products, limit class action rights or otherwise place unfair restraints on consumer legal rights. These bills encourage the manufacture of dangerous products and promote the use of deceptive and unfair practices by an already out-of-control financial service companies. - Preserving the "Fair" in the Fair Debt Collection Practices Act
NACA supports federal action that would improve the consumer protections provided by the FDCPA for consumers abused and harassed by debt collectors. NACA opposes any attempts to weaken or diminish the effect of this important law, particularly the effort by check diversion companies to receive an exemption from the FDCPA, which would limit their accountability for their notorious and obnoxious debt collection processes. - Promoting "Sustainable Homeownership"
NACA supports strong state and federal laws and policies that regulate the broken sub-prime mortgage marketplace that has lead to a foreclosure crisis greater than at any time since the Great Depression. Legislation must be passed that improves protections for all homeowners, ensures access to fair and effective legal remedies, and guarantees equal access to fairly-priced credit. - Protecting Consumers From "Rebuilt Wrecked" Automobiles
Used car fraud involving flood-damaged or crash-damaged cars affects the public health and safety, as well as the financial well-being of millions of consumers. NACA supports federal legislation that requires the destruction of flood and other excessively damaged vehicles, and created an easily accessible and complete electronic database of automobiles that have suffered damage.
